We recognize the importance of safeguarding your personal information and are committed to handling it responsibly and transparently. The collection, use, storage, and protection of personal data obtained through this Website are governed by our separate Privacy Policy, which forms an integral part of these Terms. By using this Website, you acknowledge and agree that your personal information will be processed in accordance with that Privacy Policy.

While we endeavor to maintain uninterrupted and error-free service, we do not guarantee that access to the Website will be continuous, free from disruptions, secure, or immune from defects, viruses, or other harmful components.

To the fullest extent permitted by applicable law, we expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We also disclaim any warranties arising out of course of dealing, usage, or trade practice.

10. Limitation of Liability

To the fullest extent permitted by Indonesian law, Tabiat Group, including its affiliates, directors, officers, employees, and agents, shall not be held liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use of this Website. Such exclusions of liability extend to, but are not limited to, claims for loss of profits, loss of business opportunities, loss of goodwill, loss of data, service interruptions, or any other form of commercial or financial damage, even if we have been advised of the possibility of such damages in advance.

No liability shall arise from your use or inability to use the Website, reliance on any content or information provided herein, or actions taken by third parties in connection with or as a result of your use of the Website. You acknowledge that access to and use of the Website is undertaken at your own discretion and risk, and you agree that any damages, losses, or claims that may occur are your sole responsibility, except where liability cannot be excluded or limited under applicable law.

11. Termination

We reserve the right, at our sole discretion, to suspend, restrict, or permanently terminate your access to the Website at any time and without prior notice if we reasonably believe that you have violated these Terms, infringed upon applicable laws or regulations, or engaged in conduct that may be harmful to us, other users, or third parties. Such conduct may include, but is not limited to, unauthorized use of the Website, attempts to interfere with its functionality or security, misuse of content, or actions that may damage our reputation or business interests.

Termination or suspension of access does not limit or prejudice any other remedies available to us under law or equity. Upon termination, your right to use the Website will immediately cease, and you remain responsible for any obligations or liabilities incurred prior to such termination. We shall not be liable for any loss, damage, or inconvenience that may result from the suspension or termination of your access to the Website.

12. Jurisdiction Notices

For users located in Indonesia, these Terms are governed exclusively by the laws of the Republic of Indonesia. This includes, but is not limited to, compliance with the Personal Data Protection Law (Undang-Undang Perlindungan Data Pribadi or “PDP Law”), the Law on Electronic Information and Transactions (Undang-Undang Informasi dan Transaksi Elektronik or “ITE Law”), and all related implementing regulations and guidelines that may be issued from time to time. By using this Website, you acknowledge and agree that your rights and obligations are subject to the jurisdiction and legal framework of Indonesia.

For users accessing the Website from outside Indonesia, you are solely responsible for ensuring compliance with the laws, rules, and regulations applicable in the jurisdiction from which you access or use the Website. We make no representation that the Website, its content, or its services are appropriate or lawful for use outside Indonesia. If you choose to access the Website from another jurisdiction, you do so at your own initiative and risk, and you remain fully responsible for compliance with any applicable local laws.

13. Force Majeure

We shall not be held liable for any failure, delay, or disruption in performing our obligations under these Terms where such failure or delay is caused by circumstances or events beyond our reasonable control. Such events may include, but are not limited to, natural disasters such as earthquakes, floods, storms, or fires; acts of government or regulatory authorities; strikes, lockouts, or other labor disputes; acts of war, terrorism, or civil unrest; pandemics, epidemics, or public health emergencies; and failures or outages of networks, telecommunications systems, or power supply.

During the occurrence of a force majeure event, our obligations shall be deemed suspended for the duration of the event and for such additional period as may reasonably be required to resume performance. We will make all reasonable efforts to mitigate the impact of such events and to restore access to the Website and related services as promptly as possible once the force majeure event has ceased. However, you acknowledge and agree that extended delays or suspensions may occur, and that we shall not be responsible for any losses, damages, or inconvenience arising as a result.

14. Waiver

The failure or delay by either party to enforce any provision of these Terms shall not be construed as a waiver of any right or remedy under such provision or under these Terms as a whole. Any waiver granted in connection with a specific breach or default shall not be deemed a waiver of any preceding or subsequent breach, nor shall it operate as a continuing waiver of the same or any other provision.

A waiver shall only be effective if it is expressly made in writing and signed by the party granting such waiver. Unless otherwise stated in that written waiver, no course of conduct, business practice, or repeated enforcement delay shall be interpreted as diminishing or affecting the rights of either party under these Terms.

15. Governing Law

These Terms shall be governed by, and construed in accordance with, the laws of the Republic of Indonesia, without regard to its conflict of law principles. All rights and obligations of the parties arising from or in connection with the use of this Website shall be interpreted and enforced exclusively under Indonesian law.

Any dispute, controversy, or claim arising out of or relating to these Terms, including their existence, validity, interpretation, performance, breach, or termination, shall fall under the exclusive jurisdiction of the courts of the Republic of Indonesia. By using this Website, you expressly agree to submit to the jurisdiction of the Indonesian courts and waive any objection to such jurisdiction on the grounds of venue, forum non conveniens, or any similar doctrine.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies expressly incorporated by reference, constitute the entire agreement between you and Tabiat Group with respect to your access to and use of the Website. They supersede and replace any prior or contemporaneous understandings, agreements, communications, or representations, whether written or oral, relating to the same subject matter.

No statement, promise, or inducement made by any party or representative that is not expressly contained in these Terms or the Privacy Policy shall be legally binding. In the event of any inconsistency between these Terms and other policies or notices, these Terms shall prevail, except where explicitly stated otherwise.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or competent authority, such provision shall be enforced to the maximum extent permissible under applicable law, and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any particular clause shall not affect the validity or enforceability of the other clauses contained in these Terms.
Where possible, any unenforceable provision shall be interpreted, reformed, or modified to the minimum extent necessary to make it valid and enforceable, while preserving the original intent of the parties to the greatest extent possible.
